One of the most vexed employment issues for administrators has been the extent that the Transfer of Undertakings (Protection of Employment) Regulations 2006 (TUPE) apply in an insolvency situation. Since 2011 it has been established that, where there is a sale of a business in administration, employees will automatically transfer to the buyer under TUPE.
