THE COURT OF JUSTICE of the EU (CJEU) has just given its decision in the Brockenhurst College case. The College teaches catering and hospitality as well as arts courses. As part of these courses, the College operates a restaurant, where catering students prepare meals under supervision and hospitality students provide 'front of house' service. It also put on concerts and other live performances by arts students. The College operates a database of local groups and individuals who may wish to attend the restaurant and they are informed of events through a newsletter created by the hospitality department. The charge made was about 80% of the cost of provision.
