针对高校专利技术转化, 现有研究较多地关注专利申请和质量等方面内容, 本文重点研究了专利管理过程中维持环节的不足, 认为现有管理体系容易导致潜在高价值专利失效, 造成国有无形资产的流失.本文从国有资产管理的视角, 针对高校层面提出了加强专利维护与运营的改革思路和方案, 包括建立专利失效预先申报与分析机制、设立专利维持与运营基金、通过市场化方式引入专利维持伙伴等方式;同时针对政府层面, 提出了加强对技术类国有无形资产的监管、完善知识产权维护经费预算机制、关注核心知识产权维护和救济等相应配套政策建议.%For the transformation of patent technology in colleges and universities, existing researches pay more attention to the content of patent application and quality. It focused on the lack of maintenance in the process of patent management. The existing management system could easily lead the invalidation of potential high value patents, resulting in the loss of state-owned intangible assets. From the perspective of state owned asset management, the reform for strengthening patent maintenance and operation is put forward from the university level, including the establishment of patent invalidation pre-declaration and analysis mechanism, the establishment of patent maintenance and operation fund, and the introduction of patent maintenance partners through the market-oriented mode. On the other hand, from the government level, it suggests to strengthen the supervision of the state-owned intangible assets of technology, improve the budget mechanism for the maintenance of intellectual property rights, and pay attention to the relevant policies for the maintenance and relief of the core intellectual property rights.
