第二医药用途发明专利保护问题探析

摘要

通过考察第二医药用途发明专利保护的起源与发展，揭示第二医药用途发明的本质以及瑞士型权利要求的固有缺陷。并分析了我国第二医药用途发明的立法现状，阐明了改革我国第二医药用途发明专利保护方式的必要性，同时借鉴欧洲的最新保护经验，提出了我国第二医药用途发明专利保护方式改革的路径。%Studying the origin and development of the patent protection about the innovation of second medical use, we expound the inherent defect of the Swiss Type Claim. Analyzing the current situation of legislation of innovation of second medical use in our state, draw lessons from the newest experience of protection in Europe, and put forward the reform path of innovation of second medical use in our state.
