支持机构知识库开放获取的法律朔源

摘要

在现行法律框架下，不同性质的机构知识库在内容获取与开放程度上显现出巨大差异。从版权法的产生历史分析了现行版权制度对作者与公众利益的限制原因；对我国可用于支持机构知识库开放获取的法律进行了梳理，建议机构充分利用法律行使对研究成果的使用权。%Under the present legal frame, existing the great difference between the different institutional repositories on content access and open extent.Analysis the reasons of the restrictions for author and the public interest by the history of current copyright system; combing the law that can be used to support the institutional repositories open access.Suggest making full use of the legal to exercise the right about Scientific research.
