对行政契约特权的控制及救济

摘要

行政契约中特权的存在对于顺利实现公共利益，促进行政契约如期完成具有重要的作用。但权力本身具有扩张性，对待特权的最佳途径就是对权利承认和对特权限制。在维护行政契约预期特定目标的同时，要保护行政相对人的意志和利益。当然，为使行政相对人能够实际抗衡行政契约中行政主体的特权，还需要进一步完善相关救济制度。%Executive contract privilege plays an important role in the smooth realization of the public interest and the timely completion of administrative contract.The best way to treat the privileges is to recognise and restrict the power.Meanwhile,in order to protect people from the relative effectiveness of the administrative body’s privi-lege,it must be incorporated into a variety of relief system to protect the balance of rights and obligations of the par-ties within the system.
