完善我国刑事法律援助制度的思考

摘要

The system of criminal legal aid is a kind of country’s necessary responsibility taken by the country of legal modernization, which is the basic social security right that a citizen owns and also important contents of justice for people. Although there are some provisions in the our country’s system of criminal legal aid, still exists many problems and not beneficial to protecting the legitimate rights and interests of criminal suspects and defendants. Hence, it is necessary to improve our country’s system of criminal legal aid from the aspects of legislation system, applicable objects and starting process, etc. Thereby it will protect the judicial human rights, promote the judicial fair, maintain the social justice.%刑事法律援助制度是现代化法制国家必须承担的一种国家责任，是公民享有的一项社会基本保障权利，是司法为民的一项重要内容。而我国的刑事法律援助制度虽然有一些规定，但还存在许多问题，不利于保障犯罪嫌疑人、被告人的合法权益。由此，我国的刑事法律援助制度有必要从立法体系、适用对象、启动程序等方面进一步完善，从而保障司法人权，促进司法公正，维护社会正义。
