论影响服刑人员回归社会保护的客观要件

摘要

There are many factors that affect prisoners′returning to society from both subjective and objective aspects,from both reform in prison and social acceptance outside prison.From 2012 to 2013,we visited three prisons in Liaoning province.We reach the conclusion that objective condition is major factor after analyzing statistics cases.This paper comes to the point from real conditions of prison reform when prisoners serve prison sentence and preparations of society acceptance when prisoners leave prison,focuses on analyzing the problems existing in the objective condition of affecting prisoners to return to society,and aims to establish and complete an effective protection system to help prisoners return to society.%影响服刑人员回归社会保护的因素很多，既有主观方面的，也有客观方面的，既有服刑期间监禁行刑改造方面的，也有出狱后社会接纳等方面的。通过对2012－2013年辽宁省三个监狱的调研和走访及对调查数据和案例的分析，可以看出在影响服刑人员回归社会的诸多因素中，客观要件是主要的。从罪犯服刑期间监狱改造的实际情况和出监后社会接纳保护的准备情况两方面为切入点，重点分析影响服刑人员回归社会保护的客观要件中存在的问题，以建立和完善一种切实有效的服刑人员回归社会保护机制。
