“军事法治”的核心及其制度模式

摘要

我们从军事法治的主体与军事法治中“法”的内容等角度来把握军事法治的内涵。“军事法治”作为军事现代化建设的目标模式，其核心在于：军事法律应当成为军事关系的基本调整器；军事法律应当成为军事权力的制约机制；军事法律应当是维护军事主体权利的重要工具。中国军事法治的制度化模式大体包含军事人才培养、军事法律行为、军事装备制度、军事组织编制及其军事后勤制度的法治化五方面内容。%We grasp the meaning of military rule from the perspectives such as the subject and content of military rule .The core of military rule ,as the target mode of military modernization ,is that military law become the basic regulator of military relationship ,the restraint mechanism of military rights ,and the significant tool of military subject rights maintenance .The institution mode of Chinese military rule mainly contains military talents cultivation ,military law behavior ,military equipment system ,military organiza‐tion establishment ,and legalization of military logistics .
