我国公民参与立法的过去、现在和未来

摘要

Citizen participation in legislation is a political activity, which means citizen individuals or groups are directly involved in the legislative process by putting forward proposals or opinions to influence the leg- islative decision-making as its purpose. As an important measure to reflect democratic legislation, citizen participation in legislation plays an important role in modern legislative process. In the past few decades, citizen participation in legislation experiences the process of transformation from disorder to order and or- derly form was basically achieved. At present, we must expand the breadth and depth gradually of citi- zens~ orderly participation in legislation, then make positive response to social concern so that the function of citizen participation in legislation can continue to play. Being from expanding orderly to testing effec- tively is the inevitable trend of citizen participation in legislation. The validity of citizen participation in legislation should not be neglected in the system construction ,which requires citizen participation in legis- lation play a role in protecting civil democratic rights, improving legislation quality and promoting demo- cratic legislation process.%公民参与立法,是指公民个体或团体以提出立法建议或意见的方式介入立法过程,并以对立法决策施加影响为其参与目的的一项政治活动。作为体现民主立法的一项重要举措,公民参与立法在现代立法过程中发挥着重要的作用。在过去的几十年中,我国公民参与立法经历了从无序到有序的转变过程,公民有序参与立法的形态也基本形成。当前,要继续发挥公民参与立法的功能,必须在广度和深度上逐步扩大公民对立法的有序参与,并积极回应社会的关切。从扩大有序到检验有效是公民参与立法的必然走向。关注参与的效度是我国公民参与立法制度建设不可忽视的问题,这就要求发挥公民参与立法对公民民主权利保障、立法质量提高和民主立法进程推进的作用。
