《物权法》之共用部分难点探析

         

摘要

城市人口剧增与城市建筑用地紧张之间的矛盾,导致城市建筑尤其是住宅建筑已逐渐地趋向于向高层化发展.由此,建筑物区分所有权问题随之而产生.在我国,关于建筑物区分所有权理论的研究开展得较晚,而在社会现实生活中因高层建筑物区分所有权之共有部分所产生的纠纷不断发生,因此,确立建筑物区分所有权制度已是势在必行.实践中有关区分所有权纠纷主要发生在各区分所有权人有关共有权的问题,而且共有权是建筑物区所有权制度的两大灵魂之一,所以,本文旨在对建筑物区分所有权之共有权中难点问题--天台、电梯和停车位进行深入研究.解决了这些问题,也就基本解决了建筑物区分所有权的绝大多数纠纷.%The conflicts between the leap in urban population and the tension of urban construction land, leading to the city construction, especially the construction of residential buildings have been gradually tend to the high-level development. Thus, the distinction between ownership of the building is attendant. In China, theoretical studies of the distinction between ownership of the building were carried out late, and in social life disputes due to ownership high-rise buildings are occurring, and thus to establish the distinction between ownership of the building power system is already in the pipeline. Practice on the ownership disputes occurred mainly in the distinction of the right of sharing ownership, and the right of sharing ownership is entitled to of one of the two souls of the ownership system. Therefore, this article seeks to distinguish the difficult problems in the right of ownership-the rooftop, elevators and parking spaces in an in-depth study. Solutions to these problems, it is essential to solve the vast majority of disputes in distinguishing between ownership of the buildings.
