为了有效实施绿色增长战略，有关国家和地区近年来推行绿色专利申请快速审查制度，以促进绿色技术创新与扩散。我国颁布的《发明专利申请优先审查管理办法》，虽然对激励生态创新起到一定的作用，但因在申请主题类别、审查程序及内容等方面存在的若干问题，影响其预期效果。有鉴于此，本文试图通过对主要发达国家的绿色专利申请快速审查制度的分析与总结，在考察我国绿色专利申请快速审查制度的实施现状的基础上，提出关于既能加速审查又能保障专利授权质量的政策选择和完善建议。%In order to effectively carry out the green growth strategy , some countries and regions imple-ment the expedited patent censorship for green patent applications so as to promote green technology innovation and diffusion .Although China ’ s “Administrative Measures for the Priority Examination of Invention Patent Applications” has played a role in eco-innovation incentive , its desired effect is somewhat weakened for a number of problems in the application subject categories , the review process and content and so on .Given that, this article tries to analyze and summarize the different expedited green applications patent examination systems in various developed and developing countries .Based on the study of the current implementation of Chinese expedited patent examination system for green patent applications , it proposes the reasonable policy options and proposals with aim at accelerating examination and improving quality of granted patents .
