欧美国家非物质文化遗产法律保护经验对我国的启示

摘要

在非物质文化遗产的发展与保护方面, 欧美国家有着成熟的经验. 比如政府准确地评价非物质文化遗产所具有的价值; 重视对涉及保护非物质文化遗产的法规法律的完善; 将保护非物质文化遗产的工作与相应的开发市场的工作有机地联系在一起; 从学术方面保障非物质文化遗产的发展与保护相关的工作, 重视对民众的教育宣传等. 非物质文化遗产是我国重要的文化资源, 在法律上对非物质文化遗产进行有效的保护, 不仅可以有效地防止非物质文化遗产的消失, 也有效地规范了企业、 单位以及个人对非物质文化遗产的开发活动. 文章通过梳理和研究欧美国家的先进经验, 试图获得有益启示与借鉴.%In the development and protection of non-material cultural heritage, the European and American countries have some mature experiences:Their governments can be accurate to estimate the value of the non-material cultural heritage;They payed attention to the perfect of the laws and regulations protecting the non-material cultural heritage;They combined the work of opening markets with protecting non-material cultural heritage; They develop and protect the non-material cultural heritage from scholarship and focus on the public education and publicity. The non-material cultural heritages are the important cultural resources of our country. Legally protecting the non-material cultural heritage can be effective to pre-vent the lose of the non-material cultural heritage and to regular the activities of the enterprises, unites and persons to devel-op the non-material cultural heritage. This paper is intended to give an enlightenment to our country in discussing and analy-zing the advanced experiences from the European and American countries.
