中国法律传统与法治信仰——读伯尔曼《法律与宗教》

摘要

通过对伯尔曼《法律与宗教》一书的阅读，引发了对法律信仰问题的思考，进而分析在中国语境之下，对法律的信仰究竟应该是怎么样的。信仰构筑民族的精神依赖，法律保障公民的人世周全。要建构法律信仰必须首先明确其内涵，然后具体讨论如何把中国的传统法律文化引入到当今人们的法律信仰当中，以解决我国法律信仰危机的现状、加快中国法律现代化的步伐，最终实现现今社会主义法治理念的振兴。%Based on my reading Ben＇nan＇s Law and Religion, the author has some reflections on the legal belief and makes some analysis in the Chinese context about what the legal belief should be like, what national psychological depends on and legal guarantee of citizens the world over. To construct the legal belief must first make clear its connotation, and then discussion of the Chinese traditional law culture into modem people＇s belief in law in order to solve our country legal belief crisis situation, accelerate the pace of modernization of law in China, finally realize the revitalization of the present socialist concept of rule of law.
