苗医药持有人的知识产权困境与期望调查报告——以贵州省黎平县风湿草药“泻酸灵”品牌创始人个案为例

作为黎平县至今唯一取得民族医执业资格且实际施行民族医疗的苗医,欧沛修医师自创风湿草药＂泻酸灵＂的艰辛发展历程,为众多身怀绝技却深藏民间的民族医师的发展提供了参考模型,其对知识产权工具的取舍折射出现知识产权制度对苗医药保护的实际效用与现实困境。%Ou Peixiu is the only licensed aboriginal Miao doctor practicing ethnic medicine in Liping County, and his hardship of creating rheumatism herb, ＂ Xieshuanling＂, has provided reference for the development of the ethnic doctors, who, with great talent, are still modest about their skins. Whether or not to accept intellectual property rights reflects the actual effect and current difficulties of Miao medicine system~ protection on traditional Miao medicine.
