浅论中国农村社会中精神疾病人群的选举权问题

摘要

旨在对中国农村社会中精神疾病人群的选举权进行探讨,试图提出完善该类人群选举权实现的对策。对精神疾病人群的医学标准和法学标准进行了比较,并在北京郊区进行了小样本问卷调查。通过分析发现,判定精神疾病人群的医学标准和法学标准有较大的区别。目前农村精神疾病人群选举权的实现存在一定的障碍,其原因有：制度本身的不完备性、社会公众对精神疾病人群缺乏了解和精神疾病人群分类制度与选举制度衔接不良;保障农村精神疾病人群选举权具有社会价值和法律价值。解决该问题的对策有：建立农村精神疾病人群病情登记制度、实行农村精神疾病人群病情分流制度和健全选举权的监督机制。%The aim of this paper was to explore the right to vote of mental illness in rural area in China,and to try to make people vote to achieve such improvement measures.The medical standards and legal standards of population for mental illness were compared,and meanwhile a small sample survey was conducted at the Beijing suburbs.Survey and analysis results indicated that there was a significant difference between the medical standards and the legal standards of the population for mental illness.At present,there were some obstacles on the implementation of the right to vote of rural mental patients.The reasons included the incompleteness of system itself,the lack of public understanding of mental patients,the convergence of mental patient classification system and the bad electoral system.The protection of the vote right of people with mental illness in rural areas in China had important social value and legal value.Some measures to solve these problems were presented and discussed,such as establishing a registration system for rural mental illness patients,constructing a difference between the systems of rural mental illness patients and perfecting a monitoring mechanism to vote.
