业主与承包商在合同履约中博弈分析

The success of construction procurement is the contract between the owner and the contractor can be implemented.But the owner and contractor have no willingness to implement under their private sense and no any restriction.For promoting implement,take in construction bond.Firstly,analysis it,especially the owner＇s payment bond and contractor＇s performance bond.Then,analysis the game between the owner and the contractor.%工程采购成功的关键在于合同能否履约。在个人理性和无约束条件下,业主和承包商都没积极性履约。为促使双方的履约,加入工程担保这一约束变量。首先分析工程担保的内涵,尤其是业主工程款支付担保和承包商履约担保,其次基于这两种担保类型对业主和承包商进行博弈分析,得出要使合同履约则两种担保的保额都必须大于未履约部分成本。
