中国民办高校董事会规范结构和行为结构偏差的实证分析

         

摘要

通过文本分析、访谈和问卷调查,本研究对民办高校董事会的地位、人员构成、决策机制以及与校长的关系等方面进行描述和分析。研究发现,尽管几乎所有的民办高校都声称实行董事会领导下的校长负责制,但在实际运行中,董事会往往演变成为举办者控制学校的工具。在民办高校资金来源单一的现实中,现行法规对民办高校性质缺乏明确界定和分类规范,使得以个人回报为动机的举办者必须通过加强对董事会的控制来实现自己的办学目的;同时部分法规条文表述模糊和惩罚缺失,也为行动体系偏离规范提供了可操作的空间。%Through text analysis, interview and survey, this study addresses the status, member composition, and decision-making process of the board of trustees and its relationship with university president at private HEIs. The study reveals that although almost all private HEIs claim to implement the "president responsibility system under the board", the boards of trustees at private HEIs tend to degenerate into founders' tool to control the institution. Based on Resource Dependence Theory, the study summarizes the reasons for the deviation of behavioral structure from regulative structure as follows:the single source of revenue in Chinese private HEIs;the lack of clear definition and classification of private HEIs under the current legal framework; the ambiguity of related laws and regulations and the lack of punishment mechanism.
