农村土地制度改革背景下宅基地使用权申请取得制度的问题与对策分析∗

         

摘要

农村宅基地使用权具有福利和社会保障双重功能,宅基地使用权申请取得的改革和完善是宅基地制度改革和完善的前提和基础,也是农村土地制度改革顺利开展的重要环节。文章对宅基地使用权申请取得的概念内涵进行了剖析,阐述了宅基地使用权申请取得制度的改革是农村土地制度改革的必然要求。该文针对我国宅基地使用权申请取得存在的问题进行深入分析,并在总结农村土地制度、宅基地制度研究中的宅基地取得制度研究基础上,结合当前深化农村改革及农村土地制度改革的实际,从明确集体经济组织成员资格的认定标准、合理确认宅基地申请取得资格,完善“一户一宅”、面积限定的申请取得原则和标准,严格宅基地使用权申请取得的审批,加强监督与管理等方面提出改革和完善宅基地申请取得制度的对策建议,为我国农村宅基地及土地制度改革提供理论参考。%Rural homestead land use right has the dual function of welfare and social security. China′s strict re-strictions on the transfer of homestead land use right is mainly achieved by the way of application. In this case, the reform and improvement of the application of homestead land use right is the premise and foundation of homestead system reform and improvement. And it is also an important part of carrying out the rural land system reform. This paper analyzed the concept of the application for obtaining homestead land use, and elaborated the rural land sys-tem reform of the application for homestead land use, pointed the problems from the aspects of the identification and confirmation of the application qualification, the principles and standards of "one family, one house", the area limitation, and the approval and regulatory. Based on the research on rural land system, combining with the reform of the rural land system in rural areas, this paper put forward some suggestions for the application system of obtai-ning homestead land use.
