基层公安机关刑事执法中存在的问题及原因剖析

摘要

随着我国法制化进程的加速，公安机关刑事执法办案面临更高的要求，但基层公安机关在刑事执法过程中存在诸多问题。这些问题的发生，是刑事执法人员法律意识、证据意识、程序意识淡薄，思想认识错误、业务能力有待提高等个体因素和当前的刑事执法办案体制、考核机制不合理等制度方面的因素共同作用的结果。%With the development of China＇s legal system, the basic public security organs face the increasingly high requirements in the investigation of crimes. But there are many problems in the process of the investigation of crimes. The occurrence of these problems is due to the investigators＇ weak consciousness of law, evidence, procedure, misunderstanding the law and so on. In addition, it is attributed to the current investigation system and unreasonable evaluation mechanism.
