我国农业化肥污染防治制度初探

摘要

化肥是重要的农用物资,在我国农业生产中广为使用,但其对土壤、水体等环境要素的污染和破坏作用不容忽视,对人体健康和粮食安全也存在着严重危害。我国目前防治农业化肥污染的法律制度存在较多缺陷：专门立法的强制性和权威性不足、可操作性不强、法律责任不明确等。为有效遏制化肥污染的继续恶化,我国应当完善防治农业化肥污染的法律体系,健全相关的行政管理体制,建立化肥使用的环境动态监测制度,实施农家肥使用的激励和引导机制,强化化肥污染的法律责任。%Chemical fertilizer is important agricultural materials ,it is widely used in agricultural production of our country ,but its effect on soil,water and other elements of the environment pollution and destruction cannot be ignored,on human health and food security has serious harm.China's current agricultural fertilizer pollution prevention legal system has many defects,legislation of compulsory and authority is insufficient,operability is not strong,the legal responsibility is not clear.For the effective containment of fertilizer pollution continues to deteriorate,China should improve the prevention and control of agricultural chemical fertilizer pollution legal system,perfect the relevant administrative system,build chemical fertilizer to use environmental dynamic monitoring system,the implementation of farmyard manure used to motivate and guide mechanism,aggrandizement fertilizer pollution legal liability.
