In China, the legal problems in coal mine safety training are manifest in all the three aspects' legislation, enforcement and abidance of legislation. The disarray of legislation makes the binding force weaker, difficult for coal mine enterprises to observe the legal rules, impossible for the regulators to supervise the safety training effect In the enforcement of coal mine safety training legislation, there is a predicament that the supervision organs are understaffed. As to abidance of legislation, the coal mine enterprises usually take advantage of their ascendancies and evade the legal liability, and some miners have psychological resistance to safety training. To solve the problems, it suggested that Regulations on Coal Mine Safety Training be promulgated by the State Council to get rid of the disarray, reform the enforcement model to improve the efficiency and effect, foster the miners and trade unions' consciousness of legal right safeguard to enhance the non-governmental supervision strength, and set up a compliance assistance mechanism to help the miners fulfill their liability of accepting safety training.
