Site remediation does not require a NEPA document, but it does require the equivalent ofrnone. Almost any remediation is site-controversial, as well as possibly remediation controversial.rnOne may be certain that opponents of the plan will take it to court.rnAfter the judge hears the evidence, he (or she) must make a decision. Invariably thernjudge is a former lawyer with little or no technical training. This means that the judge willrnconcentrate on the legal aspects of enabling Act requirements such as public relations,rncommunity outreach and environmental justice while not paying too much attention to morerndetailed technical aspects such as terrestrial and aquatic biology, air quality, archaeology, etc.rnToo often, studies are thrown out of court and the client is forced to start all over again becausernof inadequate public notification or participation.rnThis paper reviews the site remediation environmental needs and stresses those that mustrnbe met in order for the environmental planning for the remediation to stay out of trouble.
