The Tracking Procedure Under the New Code of Criminal Procedure

In the context of current economic and social developments in Romania, the criminal phenomenon gained new valences, often cross-border ones. Not few are the situations where judicial bodies have been confronted with people eluding the execution of a warrant of preventive arrest, the execution of a custodial sentence, a custodial educational measure, measures of medical admission or the measure of expulsion. In such cases, the police body, the administration of the detention place, the educational center or the medical facility, as well as the competent judicial body according to special law, request tracking commissioning . The procedure regulated in the new Code of Criminal Procedure, respectively the provisions of art. 521-526, comes to complete the legal framework on the tracking procedure and to align it with European regulations in the matter.
