Seising the High Court of Cassation and Justice in View to Rule a Prior Award to Solve Some Matters of Law - a Preventive Solution Able to Eliminate the Risk of Appearance and Development of a Non Unitary Case Law

At the art. 519-521 New Code of civil procedure it is established the possibility that, ex officio or upon the request of the parties, a panel of the High Court of Cassation and Justice, of the Court of Appeal or of the Court of Law, invested with the solution of the case in last instance, to request the supreme court to rule a prior decision to solve as principle, a new matter of law, on which elucidation depends the solution on the merits of the respective case.
