Registration of the Legal Person and Achieving the Legal Capacity - Right to issue statement of Claim

The novelty brought by the Civil Code, regarding the legal person, refers to the provision contained by art. 188, by which the legal person status is assigned also to other entities which are foreseen by law and to any other organizations legally founded that fulfill the requests contained by art. 187 C.civ., but which the law doesn't declare specifically as legal persons. The text of this provision refers to the situation in which certain entities, although they are not expressly accepted as legal persons, fulfill the conditions of art. 187 C.civ. and there is no provision which to deny this status. As described, art. 188 C.civ. supplies the possible omissions from some legislative acts and to give the legal person status also those structures which would have fulfill the conditions foreseen by law.
