Probation in Romania between social control and rehabilitation

The probation institution, with a recent history in the landscape of our judicial system, urges to reflection in the matter of its place and role. The present article includes several assessments over the most common dilemmas regarding probation: how much does it mean control and how much does it mean support for the convicted persons. Therefore, there had been analysed the two tendencies by reference to the three moments that mark the probation's development: the legislative establishment, the present regulation and some of the future provisions regarding probation in the new criminal legislation.
