INTRODUCTIONThis paper is a general overview of the policy justification for the adoption by the Comite MaritimeInternational of a proposed international Instrument for recognition of judicial sales of ships.It willdiscuss how present day commercial challenges facing the shipping industry are increasing thenumber of judicial sales of ships and the legal uncertainties concerning judicial sale of ships inpresent domestic and international legal regimes.
