Property Management Regulations provide problems such as proprietor and proprietor conference, property management service,use and maintenance of the property, ect. The provisions regulate the property management activities. But in practice, it has been no clear legal status of proprietor committee, such problems of the operation. Resulting in property management, property company in a strong position, legitimate rights and interests of proprietor often be damaged. This situation has already become restriction of the property management industry development of higher level. So the legal status of proprietor committee has become a core issue of the healthy development of the property management industry. In this paper,it is analyzed that legal status of proprietor committee from the current Property Management Regulations provision, proprietor committee does not have civil legal qualifications. It is analyzed that legal status of proprietor committee from the judicial practice and theory circles at home and abroad, proprietor committee is neither a legal person nor unincorporated society, it is the organization that don't have legal capacity for civil rights, it is just the autonomy organization of proprietor. After studying legal nature of proprietor committee. The conceives about proprietor committee in our property management, conceive of proprietor committee is given legal status as soon as possible, achieving full-time member of the proprietor committee, supervision system of establishment to proprietor committee is put forward in this paper.
