From Gambling Right to Gambling Regulation: Right Definition and Institutional Norms in the Perspective of Individualism

Previously the study on gambling regulation always based their argument on gambling industry, that is, analyzing positive-negative effects of gambling industry, making government adjust regulation to it, and finally providing institutional norms or policy advices. However, in respect that the complex and controversial feature of gambling industry, governmental attitude toward gambling regulation is always ambiguous. Although such orientation makes space for gambling policy, it expands the range of power rent-seeking, and also reduces the resource allocation efficacy of legitimate gambling industry such as lottery. Based on that, there is a serious policy blind that originates from the neglect of the individual demands of gambling. This paper tries to analyze gamble from the view of individualism, and advances a key concept--gambling right. Finally, it discusses the connotation and category of governmental regulation on gambling in the perspective of individualism.
