Defensive Contracting

This paper briefly outlines and describes a tested and successful program, Defensive Contracting, that when properly implemented provides large multi-national construction companies with an effective management tool for aggressively controlling the 'working layer' of safety, health, and risk on construction sites. A Defensive Contracting Program is an integrated and proactive approach to managing safety and health on diverse construction sites that focuses on risk identification, assessment, management, control, and documentation. The program incorporates all elements of the traditional risk management process including the funding and administration of risk-transfer programs, and the aggressive control and handling of claims after a loss. Implementing a Defensive Contracting Program not only promotes safer and better managed construction sites but is a proven and powerful tool for gaining a competitive advantage over the competition by lowering the overall cost and consequences of risk.
