On the Cutting Edge: Implementation of the 2002 NSRReforms in Minnesota

Minnesota has been implementing the 2002 New Source Review reform rules sinceMarch of 2003, because it is one of the seven states which are delegated to implementthe New Source Review/ Prevention of Significant Deterioration (PSD) Program by theUS Environmental Protection Agency. While no state rulemaking was required to put therules in place, a large effort was required to change permit application forms, conducttraining for permit writers and reviewers, PSD sources and consultants and to beginimplementing the rules. With over two years of experience in implementing these rules,the Minnesota Pollution Control Agency has real life experience to share in calculatingpast actual emissions, projected actual emissions, clean unit designations and plant wideapplicability limits. This paper will provide an overview of Minnesota’s implementationefforts and compliance strategy, present actual project examples, and provide informationon the use of the 2002 NSR reforms in Minnesota to date.
