IMPLEMENTING RISK-INFORMED, PERFORMANCE-BASED REGULATIONSFOR HIGH-LEVEL WASTE DISPOSAL

An important aspect of complying with Nuclear Regulatory Commission (NRC) direction toimplement risk-informed, performance-based (RIPB) regulation is development of licensing reviewguidance consistent with RIPB principles. The Yucca Mountain Review Plan (YMRP) that would beused to review any license application for a high-level waste (HLW) repository will be based on theseprinciples. RIPB review methods and acceptance criteria are being developed for each review plansection. These review methods and acceptance criteria provide the license applicant with the flexibility toselect approaches to making its safety case, provided it can demonstrate compliance with regulatoryrequirements. Similarly, they emphasize NRC’s responsibility to defend its licensing decision rather than todefine prescriptive review criteria.
