'New York State's Efforts to Encourage Permanent Treatment of Contaminated Soil at Manufactured Gas Plant Sites'

The New York State Department of Environmental Conservation (NYSDEC) has arnregulatory mandate (6NYCRR375) to return inactive hazardous waste sites to predisposalrnconditions to the extent feasible. As part of this mandate, NYSDEC is a proponent ofrnpermanent treatment of source material to the extent feasible. With respect tornManufactured Gas Plant (MGP) sites, several actions have been taken to facilitate thisrnmandate. In May 2000, NYSDEC completed a policy directive that showed greatrnflexibility in the handling and characterization of MGP waste provided the material wasrnto be thermally treated. As a result of Battery Recycling decision, NYSDEC consideredrnwhat further measures could be taken to facilitate permanent treat of residuals fromrnformer MGP sites. Toward this end, NYSDEC completed another enforcement directivernthat allowed for all coal tar containing materials generated during the remediation of anrnMGP site to be regulated as nonhazardous wastes provided it would subsequentlyrnthermally treated. This presentation will be a discussion of those two policies as well as arngeneral discussion of the remediation of MGP contaminated sites in New York.
