There are two constants in the tobacco industry: litigation and regulation. Often, it's the regulation that brings the litigation. There are currently several court cases fighting the U.S. Food and Drug Administration's (FDA) rules for newly deemed tobacco products. At least nine lawsuits have been brought by representatives of the tobacco and vapor industries. Five lawsuits were filed by companies or trade associations in the vapor segment. The first was filed by Nicopure Labs of Tampa, Florida. The others were filed by Lost Art Liquids, three vapor shops in Alabama, 11 vapor trade organizations and a West Virginia politician. A judge consolidated the Nicopure Labs lawsuit and the suit filed by the 11 vapor trade groups because the claims are very similar.
