Proposals for Evolving the Patchwork of Domestic Monopolisation and Dominance Laws

'Monopolisation' or 'abuse dominance' Jaws are designed to deal with pricing, distribution, purchasing or other market activities of individual firms that may be problematic because of exclusionary, predatory or other anti-competitive effects. Some regimes may also address exploitive prices, discriminatory conduct or 'unfair' competition. As commercial activity becomes increasingly global and competition laws proliferate, the divergences between such laws are likely to generate compliance burdens for business, conflicts between jurisdictions and chilling effects on economically beneficial conduct. This article suggests steps that individual jurisdictions and the International Competition Network can take to address these concerns and develop economically sound regimes.
