Sierra Club Off-Base in Lawsuit over Duke IGCC Case – Commission

The Indiana Utility Regulatory Commission (IURC) on November 6 told the Indiana Court of Appeals that the Sierra Club lawsuit seeking to trash a rate-cost settlement agreement covering the Duke Energy integrated gasification combined cycle (IGCC) power plant has nothing to do with earlier ethics violations by former IURC officials. In its lawsuit response brief, the IURC points out that the cost settlement agreement between Duke, the Indiana Office of Utility Consumer Counsel (OUCC) and a group of industrial electricity customers of Duke signed a revised settlement agreement that came many months after the firings of former IURC chairman David Lott Hardy and former IURC Administrative Law Judge (ALJ) Scott Storms.
