Atlantic Coast Pipeline/Dominion Transmission Defend Projects' Rate and Tariff Terms Questioned by the North Carolina Utility Commission

The projects' chief sponsors argued recently that FERC should reject the North Carolina Utilities Commission (NCUC)’s recent challenge to the return on equity (ROE) levels set for the proposed Atlantic Coast Pipeline (ACP) and the related Supply Header Project, under development by Atlantic Coast Pipeline, LLC (CP15-554) and Dominion Transmission, Inc. (DTI) (CP15-555). The joint filing of Atlantic Coast/DTI, dated 12/4/15, refuted protests and comments about Atlantic’s ACP and DTI’s Supply Header. Unlike a large group of environmentalists who are protesting (see adjacent article), the NCUC “explicitly supports the projects.” Yet the North Carolina regulators challenged certain rate and tariff proposals. Atlantic Coast, in its answer to those concerns, pledged to provide modifications of wording or clarification of certain tariff provisions, if necessary, but the project sponsors insisted the overall proposal is reasonable.
