The U.S. District Court for the District of Nebraska ordered the city of Omaha to grant a special use permit as a reasonable accommodation under the Fair Housing Act to an organization seeking to operate a treatment facility for women recovering from alcohol and drug abuse. (New Hope Fellowship, Inc. v. City of Omaha, Nebraska, No. B04CV259, 2005 WL 3508407 (D.Neb.), December 22, 2005). New Hope Fellowship, a charitable corporation organized to provide community-based residential treatment for persons recovering from alcohol and drug abuse, sought to purchase property in Omaha zoned community commercial (CC), contingent on municipal approval for use as a residential drug treatment facility for women.
