PROBLEM TO BE SOLVED: To provide an apparatus for discriminating a mobile phone using state that can determine whether a person imaged by a camera uses a mobile phone or not.;SOLUTION: A facial region is detected from an image for learning input from a camera (1 and 2). An amount of feature is extracted from right and left partial regions adjacent to the facial region (3). A discrimination function for discriminating whether the state is a mobile phone using state or not, on the basis of a data group of the extracted amounts of feature (4). Various parameter values of the discrimination function are stored in an discrimination function storage 5. A region including a face is detected from a discrimination target image input from the camera (6 and 7). The amount of feature is extracted from the right and left partial regions adjacent to the face region of the discrimination target image (8). It is determined whether the state is the mobile phone using state or not on the basis of input of the extracted amount of feature into the discrimination function stored in the discrimination function storage 5 (discriminator 9).
