PURPOSE: A packet information transmitting and receiving apparatus and a method thereof for using sub layers guaranteeing the reliability are provided to reduce a cost required to a terminal and a base station construction.;CONSTITUTION: One or more PDCP(Packet Data Convergence Protocol) layer(110) reconstructs a PDCP packet information unit of the scheduled size. An MAC(Media Access Control) layer(120) multiplexes the PDCP packet information unit to the MAC packet information unit. The MAC layer multiplexes the MAC packet information unit to the PDCP packet information unit. The MAC layer performs HARQ(Hybrid Automatic Retransmit reQuest).
