The present invention relates to an apparatus for creating a path based on a condition of a driver and a method thereof, capable of preventing a traffic accident that can be caused by a fatigued driver by determining the drivers fatigue and providing the driver with a path including roads in which an ADAS (Advanced Driver Assistance System) is normally operated when the driver in a fatigue state such that the driver can receive help from the ADAS while driving to a destination. The apparatus for creating a path based on a condition of a driver according to the present invention includes: a storage unit for storing section information of roads to which an ADAS (Advanced Driver Assistance System) is applicable; a fatigue determination unit for determining whether the driver is fatigued; and a path generation unit for generating an ADAS path to a destination based on section information of roads to which the ADAS is applicable when the driver inputting the destination is in a fatigued state.;COPYRIGHT KIPO 2019
