A method and a device for determining a background traffic transmission policy, for solving the problem in the prior art that a conflict occurs between background traffic transmission policies made by different policy control network elements for different service network elements, so that subsequent background traffic transmissions fail. In the method, a data analysis network element may determine, on the basis of target background traffic transmission policies of all the other terminal devices (i.e. a second terminal device), a background traffic transmission data analysis result of a first terminal device, and may further enable a first policy control network element to determine a background traffic transmission policy of the first terminal device. In this way, the background traffic transmission policy of the first terminal device determined by the first policy control network element refers to other terminal devices, and thus no conflict occurs between the background traffic transmission policy of the first terminal device determined by the first policy control network element and background traffic transmission policies of other terminal devices, thereby solving the problem of background traffic transmission failure.
