Vittime del fuoco, tutela preventiva di cui al D.Lgs. 231/01 e tutela risarcitoria Muovendo dal caso «ThyssenKrupp» e dall’analisi della casistica giurisprudenziale, il presente contributo illustra come l’ordinamento giuridico italiano fornisca protezione alle «vittime del fuoco», offrendo forme di tutela sia preventiva di cui al D.Lgs. 231/01 (basata su modelli organizzativi e organismi di controllo volti a prevenire il rischio di commissione di illeciti), sia risarcitoria. Résumé A partir de l'affaire «ThyssenKrupp» et de l’analyse des précédents jurisprudentielles, cet article illustre les lignes directrices sur la protection légale des «victimes du feu» en Italie. La loi italienne offre aux «victimes du feu» deux formes de tutelle différentes: celle préventive (aux termes du D.Lgs. n° 231/01), qui se manifeste par divers mécanismes de contrôle visant à prévenir les crimes, et celle pour regler les dommages des victimes. Abstract The present study proceeds from the analysis of the «ThyssenKrupp» case and from the Italian case law and focuses on the legal protection provided by Italian law for the «victims of fire», based both on ex ante protection aiming at preventing the risk of crimes (provided under the legislative decree no. 231/01 and based on organizational models and boards of supervisors) and on ex post protection aiming at awarding damages to the victims.
