摘要

The Act number 37 of 2004 on Bankruptcy and Suspension of Payment entitles the creditors to be able to apply for suspension of debt payments. The request which is made by the creditors can be exploited by bad intention debtors to enjoy their wealth during the period of postponement time of debt payment obligationsudand not to take care serio usly the wealth treasure. The problem arises whether the suspension of debt payments made by the creditors can achieve the purpose of delay debt payment obligations. This study is uses normative research method, primary legal materials, secondary legal materials, tertiary legal materials, method of collection of legal materials by studying literature, and the method uses in analyzing the data is qualitative descriptive with the flow of deductive thinking. Request of the suspension of debt payment obligations which is undertaken by the creditor against the debtors can achieve the goal only if the debtors have good intention and are serious in managing their assets in order to recover their economy and then pay their debts to creditors. The role of the supervisory judge and the board are also needed to help the debtors in order to take care of their assets so as to achieve the purpose of suspension debt payment obligations in accordance with what has been defined by the Acts.
