The Constitution of the Republic of Ecuador guarantees a healthy workplace and that this should be covered against the risks of work, considering that a military career is a profession of risks that must be estimated and if necessary should rehabilitate the soldier after an illness or accident. Taking the Andean Instrument on Safety and Health at Work and its regulation, risk prevention policy is established and work in the Labor Code Article 38 provides the employer (Armed Forces) bear the risks from work. Giving a practical and operationally, keeping the military in the best psychophysiological, physical and moral conditions can be crucial to the success of military operations. The peculiarities of strictly military missions are not incompatible with the application of security measures or those that safeguard the health and welfare of members of the Armed Forces in the development of its function.
