In article 2 of LOSNCP shows the existence of a special contract regime in the contract national system, and within that mode you'll find the contract amongst public entities. Under this contract mode, only the president of the republic can dictate its procedures under selective criteria. The absence of ruling of selective criteria in inter-administrative contracts (contracts amongst public entities) has been causing the vulnerability of the most important principles in administrative law which are legality and discretion. Due to the fact that the selective criteria has not been developed or structured in the law or the general ruling as well as how the INCOP has not published some kind of resolution in which establishes what is the selective criteria in the special regime specifically. This problem which is to be analyzed, has not been taken inconsideration in the execution of public contracts.
