La aplicación de la teoría de la imprevisión a los contratos de prestación de servicios para la exploración y explotación de hidrocarburos

The thesis studies the application of the hardship theory (teoría de la imprevisión)in the new Service Contracts of Exploration and Exploitation of Petroleum, signedbetween Ecuador and several private companies; established by the reformatory law of hydrocarbons in 2010. The hardship theory studies unforeseeable and future events that change the contract equilibrium which were originally agreed by the parties. This paper studies two circumstances under which the hardship theory can be evoked. The first circumstance is the study of a change in the cost production prices caused by an unforeseeable event.
