The present work aims to warn the reader about the need to amend Articles 437 Ato 437 J of the Criminal Code, which are responsible for behaviors that threatensanctions against the environment. After a lengthy analysis of the fundamentalconcepts of Environmental Law, Criminal Law and the Constitution in force, isdetermined to be necessary that the legislative reform of these rules, to findagreement with the fundamental law and ensure that the penalties to be increasedfulfill their preventive role.
