The Nursing Home Reform Amendments to the Social Security Act were enacted byCongress on December 22, 1987 as part of P.L. 100-203, the Omnibus Budget Reconciliation Act (OBRA '87). OBRA '87 includes new provisions affecting people with mental disabilities. The most significant is the Preadmission Screening and Annual Resident Review (PASARR). Among other things, PASARR requires states to screen individuals with serious mental illness, mental retardation and related conditions prior to admission into a nursing facility and annually thereafter to ensure the appropriateness of continued nursing home placement. This manual is produced as a training tool. It is primarily directed to advocates for the elderly and in the disability-rights community who need to understand this complex new law and be able to effect its application for the greatest benefit to consumers. In addition to explaining the PASARR screening process and appeal procedures and the nursing homes' obligation to provide mental health services, the authors have tried to identify issues calling for advocacy to ensure proper implementation of OBRA in your state and have included avocacy tips and resources the authors hope you will find useful.
